Google Terms:

Google has generously made their map services available for free use. Using the free, anonymous version of Google's map services one may make up to 25,000 map requests and 2,500 directions requests per day. Google requires, in return, that any "Desktop" software making use of their service be made available to the public, free of charge, and that a "Powered by Google" logo be included in the software. GMap Kit is designed and distributed in accord with those requirements.

Google also requires that software developers using their service inform the end-user about Google's own terms of use and privacy policy. By using GMap Kit you are using Google services. By using Google services, Google claims that you implicitly agree to their privacy policy: http://www.google.com/privacy.html and to their terms of service: http://maps.google.com/help/terms_maps.html

Google's privacy policy essentially says that they have a right to retain, commercially exploit and share any information you give them.

Google further stipulates requirements in regard to privacy policy with software that uses Google Maps.

GMap Kit Privacy Policy and Explanation:

GMap Kit is free, non-spyware, non-ad-supported software. You use it at your own risk.

The idea of a privacy policy does not apply to normal, non-spyware software like GMap Kit. GMap Kit does not, and cannot, track usage in any way. It is free, non-ad-supported software. It has no functionality to "call home" or otherwise disrespect your privacy. In fact, you can't get more private than GMap Kit. When using Google Maps online, in a browser, most people will be tracked via script, cookies, "web-bug" images, etc. You will be tracked by Google and probably several other online advertising companies. Also, a record of your map requests will probably be stored in your browser cache and history.

GMap Kit does not use a browser to retrieve maps and photos. It calls Google Maps directly and anonymously. (See the included help for full explanation.) GMap Kit sends your IP address to Google Maps, which is unavoidable. (You can't retrieve webpages, data or images from a website without them knowing your IP address, unless you use an anonymizing proxy service.) But since GMap Kit does not use a browser, there are no cookies, script, local storage cookies, web bugs, cache/history storage, or other tracking devices involved. And since there is no webpage, there is no 3rd-party spying via webpage ads, web bugs, 3rd-party cookies, iframes, etc.

A browser window is used to render directions as HTML, but the browser does not go online. GMap Kit uses the Windows API to connect directly to the Google Maps service, so there is no record of maps or streetview images in terms of cookies or cache. (Similar programs are likely to use Internet Explorer functionality, which will normally result in cached maps, even though the software author may not be aware of it.)
